I request that you wait to contact me by phone until all terms and conditions are agreed upon via email, this way we have documentation as to what was said and when.  Everything agreed upon in email is legal and binding.  If you should call before everything has been settled, then anything discussed/decided over the phone is invalid until it has also been discussed and agreed upon via email, or contract.  I have a lot on my mind day in and day out.....I will likely forget most of what we discussed, so please put it in writing. 

Although any agreements entered into through email is legal and binding, I do require a VERY detailed contract for dogs sold with full registration.  I create my contracts on a case by case bases because I do not like to leave any room for miss-interpretations.  I do not use generic, fill in the blank contracts, because those contracts tend to be too open-ended for me.  

I require half of the price of a puppy to hold until the puppy until it is ready to ship and will not hold the puppy more than 8 weeks unless other arrangements have been made.  Deposits are non-refundable, however, if something comes up and you are no longer able to purchase the puppy or dog, or you have changed your mind, the deposit may be transferred to reserve a future puppy for up to 2 years.  I will work with people who want to make payments on a case by case basis.  I also consider trades or partial trades if the puppy or stud service you offer will greatly benefit my breeding program.

We are not a wealthy family, and live payday to payday like most of middle class America, so in most cases, your payment is spent as soon as it is received, be it on vet care for your puppy (health certificates, immunizations, etc), shipping expenses (shipping crate, airfare, hotel reservations, etc), basic care (dog food, toys litter) or simply put toward other bills or household needs between paydays.  The only case in which a cash refund is given is if your puppy dies, and I am unable to replace it within two years of notification.  See the section on my Replacement Guarantee for details.

 

 

Shipping puppies is not a hobby for me, and it is not fun.  In fact, it is a very expensive, time consuming and stressful ordeal for my family and I because we get attached these puppies while socializing them, so parting with them is a stressful time for us.  I can be very easy to work with, and am very accommodating by nature, but when someone becomes difficult or demanding to schedule for,  it becomes a much more difficult and expensive task.  I will be as easy to work with as you are.

I have to drive 4 hours to El Paso Texas, to ship puppies, therefore it is in the buyers' best financial interest to want the puppy shipped at a time when I can ship other puppies at the same time.  Otherwise, my travel expenses will need to be paid by the buyer.  These expenses MAY include: Fuel: $100, Motel $80, 2 meals at $60/each for a possible total as high as $300.  This is in ADDITION to the cost off airfare, vet visit and shipping crate.  This is because the outbound flights usually leave around 6:30 am, meaning I would have to leave my house by 1-2 AM (which is quite impossible when traveling with 5 kids) to reach the airport 2 1/2 hours before departure (as required by the airlines).  HOWEVER, if you choose to wait to ship until I have another puppy to ship, I will not charge you for my travel.

If it turns out that I can not go the night before and stay in a motel,  but you insists on not waiting, you must understand that if I should get a traffic ticket, blow out a tire, or if there is a wreck that has the road blocked half the morning, I will miss the flight and have to reschedule.  I will also need to reschedule if the road conditions are poor, wind probably being the biggest danger, as there are some places over the mountains that the wind can blow someone clear off the road.  These conditions are out of my control.  It is not safe for me to travel like this and certainly not something I would "want" to do, therefore you would still be responsible for whatever travel expenses I encounter.

 I will do my best to work with your schedule, but when it comes down to it, it is my responsibility to ship the dog, and your responsibility to pick him up when he is scheduled to arrive at your airport If you are unable to pick the puppy up, then he will be scheduled for my next trip to the airport, which could be two weeks, or could be 6 weeks later.  If you are unable to pick the puppy up after 3 attempts, then a boarding fee will begin to accrue at $10 per day.   This means that you may need to miss your kids' ball practice or dance lessons, and it is up to you to decide what your priorities are.

If it is imperative that the dog or puppy be shipped around your schedule, you are more than welcome to pay for my travel expenses as described above.  But, even that does not guarantee your shipping date against matters out of my control, such as: natural disasters, weather, and airline problems. 

Should you decide not to wait for a previously scheduled trip to ship your puppy, you will only be required to pay for the actual expenses I will estimate what the expenses are expected to be, and you will pay for them in advance, then whatever funds are left over will be refunded to you.  Keep in mind that anyone who is difficult to schedule for, fits into this category, and you will be charged accordingly.  I will do my best to consider your schedule when planning a shipping date, but if you are difficult to schedule for, then this is what it will come to.

All shipping dates are tentative and subject to change at any time.  I do not increase the price of my dogs or puppies to reflect the expenses of shipping, so that cost is added to the sale price of the dog or puppy.  There are no refunds, what so ever on shipping expenses, under any circumstance.  Please remember that I am usually coordinating my shipping date with other buyers, which is not always the easiest of chores to accomplish.

 

 

Health

I offer a conditional replacement guarantee, and the conditions are as follows:

If your puppy develops any congenital (hereditary) health conditions within the first two years, which you are not willing or prepared to take care of, you may return it for a replacement.  You will be responsible for the cost of  the health certificate and airfare to return the puppy or dog back to me.  Then, when a puppy or dog of comparable value becomes available,  you will have the first right of refusal, and when you have decided on one, it will be shipped to you, at your expense, as per the terms of shipping addressed above.  There will be no cash refunds.

If your puppy or dog dies at no fault of your own, within the first 3 months, you may request a replacement at a discounted price.  This will require proof of the puppy or dog's death, including, but not limited to verifications of death, and cause of death by a vet, at your own expense.  I understand the difficulty in doing this when you are heartbroken with grief, but this is to insure that I am not scammed when the dog may not have died at all, or died because of something you did, or didn't do.  If the death is, in fact, not any fault of yours, then I will offer you a discount on a replacement puppy.  The shipping expenses depend on your urgency as per the shipping terms as stated above (the more flexible you are, the cheaper this will be).  There will be no cash refunds.

If your puppy has died within 14 days of arrival,  with a communicable disease and all the criteria mentioned above have been met, and I have not produced at least one litter for your consideration within two years, I will refund your full purchase price, which does not include any shipping or other expenses. Although my puppies are fully vaccinated before leaving to their new homes, vaccinations are not 100% protection from transmittable disease.  In the 10 years we have lived on our placed, we have never had a communicable disease come through here (knock on wood), but it is possible that a puppy can be exposed in transit.  If, however, I do produce a litter for your consideration within 2 years, but you do not like the choices, or do not pick a replacement for other reasons, I am under no obligation to refund your money.  If you are at fault in the puppies death, you will not be given a replacement or a refund.

If you are unhappy with your puppy, within the first year, you may return it for a replacement of a puppy or dog of the same sex and value at half price.  I understand that when buying a puppy over the internet, it is very difficult to get a feel for the puppies personality.  I will tell you as much as I can, but a lot can be lost in translation.  You will be responsible for all shipping expenses including airfare to ship the puppy or dog back to me, and airfare to ship the new puppy or dog to you, which includes but is not limited to, health certificates, shipping crates and my travel expenses which may include an overnight stay in a hotel, and up to three meals, and will certainly include fuel, depending on how flexible you are concerning the shipping There will be no cash refund.

When a replacement request is made, and I have authorized it, you must return the puppy back within two weeks after making the request,  and I will send you pictures of what I have available for you to choose from, when one comes available.  After you have returned the puppy, and you are not happy with the choices, you can wait until a future litter, but must pick a replacement within 2 years.  If you have not returned the puppy back to me within 2 weeks,  you would need to make another request .  You cannot request a replacement, then wait 6 months or a year to return the puppy to me and follow through with it.  The older the puppy gets, is the harder it will be for me to place him in a suitable home.  I will take back ALL puppies and dogs that I have sold, at any time, for any reason, but in order to qualify for the replacement, it has to be done under my terms.

I retain the right to refuse the sale or replacement of a puppy or dog to anyone that I feel is questionable in their pet care practices. 

 

 

All pups are sold as pets.  Some may be "Show Pets" but it is my intentions to place all my pups in homes where they will be cherished and loved as pets.

I want my best puppies shown, so I will work with legitimate show homes to make them affordable.  In order for this to happen, I will be staying on as co-owner of the pup, and you will have to sign a detailed contract stating my expectations for the pups' showing and breeding future.  A copy of the registration certificate will be staying with me until I am satisfied that your true intention is to show the dog, and you are not just "playing along" so that you can get what you want.  As soon as the dog finishes his or her AKC champion title, I will sign off on the certificate, giving you full AKC registration, and send you the papers provided that all terms have been met.  Signing over full ownership does not release the buyer from the terms of the contract.  My prices for show prospects start at $1200-$2500, depending on quality and pedigree.  I do not sell my puppies to breeding homes that do not show on some level.

I make no claims as to "show quality" only show potential.  I have been told that I have a good eye, however, I am not experienced enough or qualified to determine with absolute certainty, if a puppy is of show quality.  I will, however, set them up in photos so that you can take or send the pictures to other people in the industry and ask their advice.  I will tell you of their good and their bad qualities, to help you in your decision, but the bottom line is that you need to educate yourself, in order to make the final decision.  Look at lots and lots of puppy show-photos, and read as much as you can on the breed.  I am overly critical of my dogs, and I will tell you what I think can be improved upon.  I would rather over-state their faults and weaknesses and have the buyer surprised that "its not so bad as I let on" than to under-state them, and have the buyer disappointed in any way.

If you want a full registration, with no strings attached, expect to pay more....alot more, and I must receive pictures of your home and property, as well as pictures of your other dogs and a resume of the dogs you've shown.  I will also need references from your vet, and people who have done business with you before.  The more pictures and references, the better.  Full registration will only go to pet homes that also breed and show.  If your dogs live in cages, don't waste your time asking about my puppies.

Puppies sold to pet homes will receive a Limited registration with spay/neuter contract and I will hold the papers until they have been altered.  Once the surgery has been performed, prove it to me, and I will send the limited AKC papers to you.   If the pup is 6 months or older when it is sold, it will be altered before leaving, at buyers expense.  The registration papers will not be released until the agreement has been fulfilled.  My pet price with the spay/neuter contract is $700, and this is negotiable to the perfect homes.

 

I have the right to refuse the sale or replacement of a puppy or dog to anyone that I feel is questionable in their pet care practices.
